[Page 1] [Texto Principal] copia H.4. = copia da carta em respeito commissão dos Cathólicos de Malaca). = Illustríssima Senhores = debaixo a Nossa presença a representação da commissão datada de 12 de Dezembro ultimo na qual, de um lado se referiam as pretensões do Vigário Apostólico de Macau para sujeitar a sua jurisdição os Cathólicos de Malaca em virtude do Bre- ve Muita proclara, e de um Decreto da P. Congrega- ção de três de Janeiro de 1840, e de outro os esforços, que o Reverendo Francisco Jones, Governador desse Bispado, havia feito contra as estranhas pretensões dos Missionários mandados pelo Reverendo Bembe, dizendo-lhes, que não queria ceder a eles as Igrejas da sua jurisdição até que recebesse ordens positi- vas do seu superior de Goa, mas como essa com- missão se acha em uma perplexidade a respeito da verdadeira jurisdição, é preciso, que Nós o decla- remos para se evitarem todas, e quaisquer injusti- ças, que possam haver sobre este objecto.

Santidade não pode dispor do alheio contra a vontade de seu dono, nem por si só pode desfazer o que é estabelecido por Direito, e convenções mu- tuas entre S. Santidade, e soberanos de Portugal, e por isto deste lado o Breve Multa proclamare, ou é suposto, ou obtuso, e subreptício, e por tanto inadmissí- vel nos Bispados Portugueses como muitas vezes já se tem demonstrado. = 2.º No caso mesmo que elle fosse verdadeiro, ou admissível, estabelecendo-se por aquele Breve disposições provisórias, ficam ellas revogadas à vista das Bulas da Nossa Confirma- ção, que são idênticas com as dos Nossos Antecesso- res, e pelas quais se Nós confere a mesma jurisdi- ção em toda a sua amplitude, que expressa ultima- mas, o Intr. [Page 1] [Texto Principal] .revela multa proclamada uma referida pela Bula Encíclica dirigida aos suffragâneos da Metrópole de Goa para Nos reconhecerem, e obedecerem como seu Metropolita; pois se ainda deveria subsistir aquele Breve, que V. deixou intacto o Bispado de Macau, não haveria lugar para a referida Encíclica, mas apenas para uma Bula a este único Bispo. = Nós teremos a satisfação de mandar para Malaca uma cópia autêntica tanto das novas Bulas, como das do Nosso Antecessor, logo que as recebamos em Goa, o que agora não podemos fazer pelas Nossas muitas ocupações, e afazeres, principalmente os da visita, a questão procedendo nestas partes da nossa Diocese ao Norte de Goa sujeitas ao Governo Britânico. A vista do que esta Comunhão, e os Católicos seus constituintes, continuando a sujeitar-se, como até agora, ao seu actual Prelado, que somos Nós, e por Nossa delegação ao R.º Francisco James, Governador deste Bispado, obedecem a Deus, e ao seu Vigário na terra o Santíssimo Padre Gregório XVI, cujas ordens, vontade constam pelas mencionadas Bulas da sua Confirmação, as quais são hoje a mais.

Most Illustrious Sirs,
Under Our authority, we present the representation submitted by the Commission, dated 12 December last, in which, on the one hand, reference is made to the claims advanced by the Apostolic Vicar of Macau seeking to bring the Catholics of Malacca under his jurisdiction by virtue of the Brief *Multa praeclare* and a Decree issued by the Sacred Congregation on 3 January 1840; and on the other, to the efforts undertaken by the Reverend Francisco Jones, Administrator of that Diocese, who opposed the extrajudicial claims of the missionaries sent by the Reverend Bembe, informing them that he would not surrender to them the churches within his jurisdiction until he received explicit orders from his superior authority in Goa.
However, as this Commission finds itself in a state of uncertainty regarding the true ecclesiastical jurisdiction in this matter, it is necessary that We provide a formal declaration, so as to prevent any and all injustices that might arise therefrom.

of their ancestors and legitimate bishops, the first who brought them into the fold; your representation addressed to Us as their true Prelate has filled Us with pleasure, as it seeks to prevent the unjust insinuations of those who desire to enter into another’s field. Therefore, in accordance with what the Commission requests of Us, We are obliged to declare the following, so that it may be made fully known to all Catholic constituents in the most public and solemn manner:
1. It is clear that His Holiness cannot dispose of what belongs to others against the will of its rightful owner, nor can he unilaterally undo what has been established by law and mutual agreements between the Holy See and the sovereigns of Portugal. Hence, from this standpoint, the Apostolic Brief *Multa proclamare* is either fictitious, obscure, or surreptitiously obtained, and therefore inadmissible within the Portuguese bishoprics—as has already been demonstrated on numerous occasions.
2. Even were this Brief genuine or admissible, and even if it were to establish provisional dispositions, such provisions would nonetheless be revoked in light of the Papal Bulls of Our Confirmation—identical to those issued by Our Predecessors—by which We are granted full jurisdiction in its entirety, as expressly stated under *Intr. L. Saldino*.

Let no one harbour any fear of disobedience towards the supreme Head of the Church. We have already declared this position to the said Revd. Jones in Our Court, and have likewise written, on this same date, in reply to the Revd. Fathers Bergaudetti and Ber vel, Missionaries of the Propaganda, instructing them that they must withdraw from this Diocese as soon as possible, under penalty of disobedience to the supreme Head of the Church, leaving the said Revd. Jones free to exercise his legitimate jurisdiction. For he, as Our Delegate, is the rightful and true superior of the Catholics whom this Commission represents.

Jones, and likewise have written in reply to the Revd. Fathers Bergaudotti and Bervel, Missionaries of the Propaganda, dated as such, instructing them that they must without delay—under penalty of disobedience to the supreme Head of the Church—withdraw from this Diocese, leaving to the aforementioned Rev. [Page 1] [Main Text] It is evident that the aforementioned penalty was proclaimed through the Encyclical Letter addressed to the suffragan bishops of the Metropolitan See of Goa, instructing them to acknowledge and obey Us as their Metropolitan. For if the earlier Brief, by which Your Excellency left the Diocese of Macau intact, were still in force, there would be no basis for the said Encyclical; instead, a Bull addressed solely to that one Bishop would suffice.
We shall have the satisfaction of sending an authentic copy both of the new Bulls and of those issued by Our Predecessor to Malacca, as soon as we receive them in Goa—something which We are currently unable to do due to Our many duties and pressing affairs, particularly the canonical visitation now underway in those northern regions of Our Diocese under British administration.
In view of this, this Community and the Catholics comprising it, continuing to submit themselves—as they have done hitherto—to their present Prelate, who is Ourselves, and by Our delegation to the Reverend Francisco James, Governor of this Diocese, remain obedient to God and to His Vicar on earth, the Most Holy Father Gregory XVI, whose commands and intentions are clearly expressed in the aforementioned Bulls confirming this arrangement, which now hold full authority.
