Abstract

Francisco Jones, Governador do Bispado, não tem querido obedecer, tendo por várias vezes insistido em que não receberá ordens a este respeito senão da Autoridade Eclesiástica de Goa, e por isso Nos pedem que hajamos por bem de terminar esta questão, mandando ao dito Governador do Bispado entregar a N.M.ª as Igrejas, no caso de não estarem alteradas as disposições do Breve *Multa podere*, previamente respondendo a esta Carta com clareza. — T.E. é claro que Sua Autoridade não pode dispor do alheio contra a vontade do seu dono, nem por si só pode desfazer o que é estabelecido por Direitos, relações mútuas entre Sua Santidade e os Soberanos de Portugal, e por isso, deste lado, o Breve *Multa podere*, ou o suposto, ou obtido, e subreptício, se [Anotações marginais] [No topo, à esquerda] = copias A° B. = [No topo, à direita] .e Metrópole = v.

Francisco Jones, Governor of the Diocese, has been unwilling to comply, having on several occasions insisted that he will receive no orders on this matter except from the Ecclesiastical Authority of Goa; wherefore you request that We be pleased to resolve this issue by instructing the said Governor of the Diocese to deliver the churches to Our Most Holy Lord, provided that the provisions of the Brief *Multa podere* remain unchanged, and further requesting a clear response to this letter.—T.E. As Our Most Holy Lord affirms in the decree issued by the Apostolic Secretary on 3 January 1840—declaring incapacity—Mgr. Francisco Jones, Governor of the Diocese, has refused to comply. On multiple occasions, he has maintained that he will accept no instructions on this matter other than from the Ecclesiastical Authority of Goa. In light of this, you petition Us to bring this matter to resolution by directing the aforementioned Governor of the Diocese to surrender the churches to Our Most Holy Lord, should the provisions of the Brief *Multa podere* remain in force, and you further request a clear and explicit reply to this letter. — T.E. It is clear that His Authority cannot dispose of another’s rights against the rightful owner’s will, nor can he, by his own authority, overturn arrangements established through formal rights and reciprocal agreements between His Holiness and the Sovereigns of Portugal. Admissible, in times such as these, as has frequently been demonstrated before. Even assuming that it were true, it would still be inadmissible; for, with the establishment of those provisional arrangements, they are hereby revoked in view of the Bulls of Our Confirmation, which are identical to those issued by Our predecessors, and by which We are conferred the same jurisdiction in its full extent as is exercised by the most eminent Primate, Lord D. Galdino. — 3rd. The unsubstantiated nature of the said Brief *Multa proclame* becomes yet more evident through the Encyclical Bull addressed to all the suffragan bishops of the Metropolitan See of Goa, instructing them to acknowledge Us and obey Us as their Metropolitan; for if that Brief— which only temporarily exempted the Diocese of Macao—were still intended to remain in force, there would have been no need for the aforementioned Encyclical, but rather only a separate Bull directed exclusively to that single bishop.

[Page 1] [Main Text] British Government. — In view of the intention expressed by His Majesty our Sovereign to intervene in the matter concerning the appointment of the Apostolic Vicar of Angapura, as well as the churches of Malacca and other jurisdictions within that diocese, we declare such intervention to be inadmissible. This decision of Ours shall settle all disputes on the matter, as the Most Illustrious Prelate affirms in his letter. Therefore, as legitimate Metropolitan, we require Your Majesty to withdraw from the aforementioned Diocese of Malacca, leaving unimpeded the exercise of jurisdiction by the rightful superior—namely, the Governor of the Diocese. We trust that Your Majesty will promptly comply with this demand out of obedience to the supreme head of the Church, whose authority and will are clearly set forth in the aforementioned Papal Bulls of Our Confirmation. These Bulls now constitute the sole rule and law governing this matter, and we are fully resolved to uphold their literal implementation in its entirety. In this same sense, we have already communicated to the Reverend Governor of the Diocese of Malacca, as Your Majesty has requested.
